Jacksonville, FL (October 20, 2018) - A pickup truck collided with a Jacksonville Transportation Authority bus on Thursday, October 18th.
The driver of the pickup truck, Donald Bennett, was traveling on Springfield Boulevard when he came to a stop sign. Bennett ran through the stop sign and collided with the transit bus on 44th Street. Bennett's truck erupted in flames. He suffered several injuries and was taken to the emergency room following the crash. He says he is still in considerable pain. In addition to Bennett, three of the bus passengers also suffered minor injuries.
On Friday, Bennett said he never saw the stop sign because it was obstructed from his view by a large palm tree. The tree was removed on Friday, less than 24 hours after the crash. Bennett says that the city should be held responsible for the crash because they created an unsafe condition on the roadway by allowing the sign to be blocked by the tree. A spokeswoman for the city reminded citizens to report roadway obstructions to the city's customer service team.
In this crash, it remains to be seen what, if any, responsibility, will be taken for the condition of the stop sign. In cases of crashes obstructions or defective conditions on roadways, a city or local government may be held responsible if a crash occurs. In such cases, a personal injury claim could potentially be brought against the governmental unit for failing to maintain the road in a safe condition.
