Miramar, FL (September 19, 2018) - A grandmother died on Tuesday, September 18th after being struck by a vehicle while walking her grandson to school. 79-year-old Marie St. Vil was crossing the street at Miramar Parkway and Fairmont Avenue around 9:00 am when the crash occurred.
St. Vil was with her 13-year-old grandson, Edwin St. Vil and they were walking together when a Chrysler 300 ran a red light, striking both of them. Marie St. Vil was rushed to Memorial Regional Hospital in Hollywood where she succumbed to her injuries. Edwin St. Vil suffered a broken foot and bumps and bruises in the crash.
Witnesses reported that both Edwin and Marie were walking in a marked crosswalk when they were struck. The Chrysler 300 had heavy front-end damage from the impact. The driver did stay at the scene to cooperate with police. Charges are pending in the case.
Last year in Florida, over 10,000 pedestrians were hurt in crashes with vehicles. A pedestrian crash may occur for a variety of reasons, including:
When an accident takes place that is not the pedestrian's fault the pedestrian has certain legal rights. In Florida, a pedestrian may bring a personal injury claim against the tortfeasor. A tortfeasor is a legal term for a person who acts negligently, causing an injury. There is enough information at this time to determine fault in this crash and it appears as though the driver will be liable both for the death of Marie St. Vil as well as the injuries suffered by Edwin St. Vil.
