Madison County, FL (September 4, 2018) - Authorities with the Florida Highway Patrol were on the scene of a serious rollover crash Sunday. The accident happened in Madison County on CR 255 just before 10:00 am.
According to police, a Chevy Venture driven by a 29 year old woman was traveling southbound when it left the roadway, crossed over the left shoulder and overturned off the side of the roadway. Three children, ages 1, 8 and 10 were passengers in the vehicle when the rollover occurred. The baby was apparently ejected from the vehicle and was transported to Shands Hospital via medical helicopter. The child is described as having serious injuries but not life-threatening.
The remaining occupants of the vehicle sustained only minor injuries. FHP troopers cited the driver for driving without a license, careless driving, and improper use of child restraint.
Single car accidents can be just as deadly and serious as accidents involving multiple vehicles. When a driver chooses not to follow traffic laws and drives recklessly everyone is at risk. Both other drivers as well as passengers in the vehicle have a right to expect that the driver will operate their vehicle in a safe manner, in compliance with all rules of the road. This is especially true when children are involved.
Any time an injury occurs due to negligence on the road, those affected may bring a legal claim against the other driver. In cases involving minors, a claim may still be brought on behalf of the minor by an adult who represents the minor's interests in the legal proceeding. Court approval of the settlement may or may not be required depending on the amount received. Typically, any settlements less than $15,000.00 in a case involving a minor do not have to be approved by a court. Settlements above that amount must normally be reviewed and approved by a judge.
