Middleburg, FL (September 10, 2018) - A pedestrian walking along Baxley Road died after being struck by a vehicle on Monday.
Cody Kinney, 34, was walking southbound in the northbound lanes of Baxley around 5:40 am. A GMC Envoy traveling northbound struck Kinney. Rescue personnel arrived on scene where, unfortunately, Kinney was pronounced dead from severe injuries sustained in the crash.
The unidentified Envoy driver remained at the scene following the collision. The driver cooperated with police, according to the Florida Highway Patrol. The intersection remained closed for hours while police investigated and eventually re-opened around 8:00 am.
Charges are pending in the crash but police have not revealed the nature of the charges.
Pedestrian accidents happen across Florida on a daily basis. Many of these accidents will be severe and even deadly in nature. The majority of pedestrian crashes occur late at night and early in the morning in poorly lit areas. When a pedestrian accident happens, police will investigate the scene and determine who was at fault in the crash. The police investigation in this case will focus on the events leading to the accident, such as whether the driver or pedestrian violated any traffic laws and whether the driver could have taken measures to avoid the collision. If the driver was negligent in causing the crash, the pedestrian's surviving family members will have a potential wrongful death claim against the driver.
