Orlando, FL (January 4, 2019) - A man was hospitalized on Thursday, January 3rd after his car collided with a slow-moving train in Orlando. The incident took place on North Orange Blossom Trail. According to reports from the scene, the man was traveling in a sedan that crossed over the railroad tracks in the area when it was struck by the train.
Witnesses indicate that the train was moving slowly at the time of impact. It is unclear what caused the car to collide with the train at this time. The airbags in the vehicle deployed during the collision and the back window was also blown out. The driver was taken to an Orlando Hospital. There is no further update on his condition at this time. Some who live nearby the crossing say that there is little warning of a railroad crossing in the area and that the area where the crash occurred does not have any gates or arms that come down to signal the approach of a train. The railroad is owned by Florida Central Railroad.
No further information is available.
Our thoughts go out to the man injured in this Orlando crash. Each day, dozens of accidents will be reported in our state. This crash is somewhat unique in that there could be an issue of liability on behalf of the railroad. Entities that maintain road signs, stop lights, railroad crossings and other street markers have a duty to ensure that they are maintained and set up in a safe manner. If they create an unreasonable risk of danger then the owners could face liability. In this case, the railroad could be looking at taking responsibility for this crash if the marked area failed to adequately warn approaching drivers of the oncoming train.
