Polk County, FL (August 30, 2018) - A woman died after being struck by a vehicle along Interstate 4 early Thursday morning.
According to reports, Jade Marie Hicks was a passenger in a 2011 Ford Ranger F-150. The F-150 was being operated by her boyfriend Alvaro Perez. Hicks's 13 year old daughter was also in the truck.
Hicks and Perez apparently got into an argument and both exited the vehicle. The two began walking on the highway. Suddenly, Hicks stepped into the roadway and was struck by a 2010 Nissan Frontier operated by 38 year old Dustin Joseph Donaldson.
Hicks died at the scene from her injuries. There were no citations issued in the crash.
Last year in Florida, over 10,000 pedestrians were hurt in crashes with vehicles. A pedestrian crash may occur for a variety of reasons, including:
- Driver inattention or distraction
- Failure to stop at stop signs or red lights
- Speeding
- Failure to yield to pedestrians in a crosswalk.
When an accident takes place that is not the pedestrian's fault the pedestrian has certain legal rights. In Florida a pedestrian may bring a personal injury claim against the tortfeasor. A tortfeasor is a legal term for a person who acts negligently, causing an injury. The injured person may recover for a variety of losses, including pain and suffering, past and future medical treatment and lost wages.
