St. Petersburg, FL (September 25, 2018) - A motor scooter rider was killed in a crash on Sunday, September 23rd in St. Petersburg. Police with the St. Petersburg Police Department responded to a call involving the crash at the intersection of Fifth Avenue N and Eighth Street around 2:22 am.
Police began a traffic investigation and discovered that 58-year-old Vallis Ann Oswain was riding a motor scooter in the intersection. Oswain had a green light and proceeded through the intersection where she was struck by a 2012 Volkswagen Jetta driven by 39-year-old Harshit Srivastava. Srivastava was traveling westbound on Fifth Avenue and apparently entered the intersection against a red light. The side of Oswain's scooter collided with the Jetta, throwing Oswain and her passenger, Daniel Jay Foreman, to the ground.
Oswain was pronounced dead from her injuries at Bayfront Health St. Petersburg. There is no word on whether Foreman suffered injuries.
Police are still investigating this crash but do not believe that alcohol played a factor.
This is certainly a tragic crash that occurred in St. Petersburg. Though only 0.6% of vehicle miles are traveled by motorcycle, a staggering 14% of all motor vehicle crash deaths involve motorcyclists While motor scooter riders are far more vulnerable than those in typical vehicles, they are still motorists and the same traffic laws apply to them as to everyone else. They are entitled to the right of way at intersections and other drivers must yield to a scooter as they would yield to any other vehicle. Sadly, it appears that the failure to stop at a red light directly caused the death of Victoria Oswain. Her family will now consider filing a wrongful death claim against Harshit Srivastava for Srivastava's apparent negligence in causing this crash.
