Winter Garden, FL (August 22, 2018) - A head-on collision Tuesday in Winter Garden claimed the life of one man. According to reports, 52 year old Benny Torres died in the crash. Torres was driving a 2001 Nissan on Avalon Road around 5:45 am Tuesday. Torres's vehicle was struck head-on by a 2016 Chrysler van driven by a woman named Catherine Burzynsky. Burzynsky was traveling north on Avalon when she crossed over into the southbound lanes, striking the Nissan driven by Torres. Following the initial impact, the Chrysler struck a third vehicle, a 2016 Jeep, being operated by 64 year old Richard Garcia of Clermont.
Torres suffered serious injuries and was airlifted to Regional Medical Center where he later succumbed to his injuries. Burzynsksy was also seriously injured but there is no further word on her condition. There is no indication that Garcia was hurt.
Police believe that the accident occurred due to unfamiliarity with the road. Burzynsky, of New Jersey, was vacationing in Winter Garden at the time of the collision.
Our thoughts and sympathies are with the family of Benny Torres. We also hope that Catherine Burzynsky recovers from her injuries in this crash.
At this time, it appears as though Burzynksy was negligent in causing this collision. As a result of her negligence, Torres's surviving family will have the right to bring a wrongful death claim. In Florida, a wrongful death claim must be filed within two years from the date of the accident. The surviving family member bringing the claim may recover for loss of companionship, mental and emotional pain and suffering and medical or funeral expenses.
